Can I Cancel a Painting Contract in North Carolina? The Three-Day Home Solicitation Rule

By Matthews Painting Pros · Published · Updated

Front of a suburban house

North Carolina's Home Solicitation Sales Act generally lets a buyer cancel a home solicitation sale until midnight of the third business day after signing, by giving written notice. It is the state's version of a cooling-off period for contracts signed at home after a seller personally solicits you.

When It Applies

A home solicitation sale is one where the seller personally solicits the sale and the buyer signs the agreement at the buyer's residence. Door-to-door sales pitches are the classic example. See N.C. Gen. Stat. 25A-39 for the statute.

How to Cancel

Send written notice to the seller before midnight of the third business day after you signed. The notice does not need a special form; it is enough if it shows in writing that you do not intend to be bound. Keep a copy and proof of when you sent it.

The Emergency Exception

If you ask the seller in a separate written statement to provide goods or services without delay because of an emergency, you may give up the right to cancel. That is meant for true emergencies, not routine painting.

Other Protections

Separately, unfair or deceptive trade practices are prohibited under North Carolina law, and complaints can go to the NC Department of Justice consumer protection division. This article is general information, not legal advice.
